These Terms of Service (“Terms”) form a binding agreement between you and BidSage AI (“BidSage AI”, “we”, “us”, or “our”) governing your use of the website at https://bidsageai.com and the related products and services (together, the “Service”). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. Description of the Service
BidSage AI is an AI-assisted platform that reads government tender and RFP documents and produces analysis — such as eligibility criteria, compliance checklists, risks, mandatory documents, and submission deadlines — and can draft bid proposals for you to review and edit. The Service is a decision-support tool that helps you read and respond to tenders faster; it does not submit bids on your behalf and does not replace your own professional judgement.
3. Accounts & eligibility
You may use a single one-off analysis without an account. To use the Service on an ongoing basis, you must create an account and provide accurate information. You are responsible for keeping your login credentials confidential and for all activity under your account. You must be at least 18 years old and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
4. Plans & pricing
- Free — you get 1 analysis without signing up. With a free account you get 3 analyses every month at no charge.
- Pro — for higher volumes, unlimited analyses, and proposal generation, we offer custom pricing. Contact our team at support@bidsageai.com to discuss a plan that fits your needs.
Plan limits, features, and pricing may change over time; we will communicate material changes before they affect you. Billing terms for Pro plans are agreed directly with our team.
5. Acceptable use
When using the Service you agree that you will not:
- use the Service for any unlawful, fraudulent, abusive, or harmful purpose;
- upload content you do not have the right to upload, or that infringes the rights of others or breaches confidentiality obligations;
- attempt to scrape, crawl, reverse-engineer, or extract the Service or its underlying models, or circumvent usage limits, rate limits, or security controls;
- interfere with or disrupt the Service, or attempt to gain unauthorised access to it or to other users’ accounts or data;
- resell, sublicense, or build a competing product using the Service without our written permission; or
- upload malware or use the Service to transmit harmful code.
6. AI-assisted nature & no guarantee
BidSage AI is an AI assistant. Its analysis and drafts are generated by AI and may contain errors, omissions, or inaccuracies. We do not guarantee the accuracy, completeness, or suitability of any output, and we do not guarantee that using the Service will result in a winning bid or any particular outcome. You must independently review the original tender document and verify every requirement, eligibility condition, and deadline before submitting any bid. You remain solely responsible for your bids and for any decision you make using the Service.
7. Intellectual property
We own all rights in the Service itself — the platform, software, models we integrate, design, and trademarks (including “BidSage AI”). We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
You own your documents and outputs. The documents you upload remain yours, and the analysis and proposal drafts generated for you are yours to use for your bidding purposes. You grant us only the limited rights needed to process your documents and deliver the Service to you, as described in our Privacy Policy.
8. Disclaimers & limitation of liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. BidSage AI provides decision-support only and is not legal, financial, or professional bidding advice. See our Disclaimer for more detail.
To the maximum extent permitted by applicable law, BidSage AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, contracts, bids, data, or goodwill, arising out of or in connection with your use of the Service — including bid outcomes, missed deadlines, or eligibility decisions made in reliance on its output. Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid us for the Service in the three months preceding the event giving rise to the claim, or, if you are on a free plan, to a nominal amount.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after an update means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws of India, and the courts of India will have jurisdiction over any dispute arising out of or relating to them, subject to any mandatory consumer-protection rights you may have.
